In this paper we trace the historical exclusion of women from the legal profession in Canada. We examine women’s efforts to gain entry to law practice and their progress through the last century. The battle to gain entry to this exclusive profession took place on many fronts: in the courts, government legislature, public debate and media, and behind the closed doors of the law societies. After formal barriers to entry were dismantled, women continued to confront formidable barriers through overt and (...) subtler forms of discrimination and exclusion. Today’s legal profession in Canada is a contested one. Women have succeeded with large enrolments in law schools and growing representation in the profession. However, women remain on the margins of power and privilege in law practice. Our analysis of contemporary official data on the Canadian legal profession demonstrates that women are under-represented in private practice, have reduced chances for promotion, and are excluded from higher echelons of authority, remuneration, and status in the profession. Yet, the contemporary picture of the legal profession also reveals that women are having an important impact on the profession of law in Canada by introducing policy reforms aimed at creating a more humane legal profession. BackgroundConcerns about decision making related to resuscitation have led to two important challenges in the courts resulting in new legal precedents for decision-making practice. Systematic research investigating the experiences of doctors involved in decisions about resuscitation in light of the recent changes in law remains lacking.AimTo analyse the practice of resuscitation decision making on hospital wards from the perspectives of doctors.DesignThe data presented in this paper were collected as part of a wider research study of end-of-life care in an acute (...) hospital setting. Data collection comprised ethnographic non-participant observation on two acute hospital wards and individual interviews with patients, relatives and healthcare professionals caring for patients thought to be approaching the end of life. Data were analysed using a constructivist grounded theory approach.ResultsDiscussions and decision making about resuscitation present many challenges for those involved on acute medical wards. The data highlight the potential for multiple interpretations of legal precedents, creating misunderstandings that may impact patient care in less positive ways.ConclusionsThis paper provides unique insights into how doctors respond to the changing medico-legal culture and the subsequent effects on patient care. It demonstrates how the juridification of medical practice can occur. It highlights the potential benefit of a structure to support clinicians, patients and relatives in discussing and navigating decisions around care at the end of life in line with the patient’s wishes and preferences. Sacrifice haunts the Phaedo. In this article, I argue that the mise-en-scène of the death scene of the Phaedo, as well as other sacrificial elements in the background of the dialogue, creates a nexus that positively integrates the birth, philosophical practice, and death of Socrates into the ritualized rhythm of the life of the city of Athens. A close reading of the death scene presented as a synopsis with Walter Burkert’s well-known analysis of Greek sacrifice reveals convergences and divergences between (...) the Phaedo and Greek sacrificial practice. Socrates appears as a willing victim who accepts the city’s sacrificial practice while remaining on his own terms. (shrink)

Forty-two essays by authors from five continents and many disciplines provide a synthetic account of the history of the social sciences-including behavioral and economic sciences since the late eighteenth century. The authors emphasize the cultural and intellectual preconditions of social science, and its contested but important role in the history of the modern world. While there are many historical books on particular disciplines, there are very few about the social sciences generally, and none that deal with so much of the (...) world over so long a timespan. This paper proposes an explanation in terms of three kinds of freedom, first for the special efficacy of science in general and then for why such efficacy has been more impressive in the natural than the social sciences. This explanation thus complements "post-positivist" interpretations of science which argue that science's effectiveness cannot be accounted for by fundamental epistemic differences from other kinds of discourse. My explanation tries to say what is responsible for science's effectiveness, in purely nonepistemic, sociological terms. All (...) of the three kinds of freedom have so far been denied to most other forums, including in particular nations' populations taken overall. And one of these freedoms, while now allowed to the natural sciences, is still denied to the social sciences. (shrink)

John F. Kavanaugh and W. Norris Clarke, two twentieth-century Jesuits, contributed to philosophy through their development of a Thomistic and personalist view of reality emphasizing the human endowments of knowing, freely choosing, and loving. While spiritual exercises played a role in the formation of both Jesuits, the function of spiritual exercises in their own philosophy has not been explored. Recent interest in philosophy as a way of life provides a means by which this can be accomplished. In their work Michel (...) Foucault and Pierre Hadot have shown how spiritual exercises function in the formation of the self and in the acquisition of a synoptic vision that allows contemplation of one’s participation in the whole. This paper shows that while Kavanaugh primarily uses spiritual exercises in his philosophy to accomplish a disciplinary/formational aim Clarke’s aim is dialogical/exploratory. A brief examination of the Spiritual Exercises of Ignatius of Loyola reveals how these different aims in fact complement one another. (shrink)

Models of risk-taking as used in the social sciences may be improved by including concepts from life history theory, particularly environmental unpredictability and life expectancy. Community college students completed self-report questionnaires measuring these constructs along with several well-known correlates. The frequency of risk-taking was higher for those with higher future unpredictability beliefs and shorter lifespan estimates (as measured by the Future Lifespan Assessment developed for this study), and unpredictability beliefs remained significant after accounting for standard predictors, such as sex and (...) temperament. The results demonstrate the usefulness of applying concepts from life history theory to enhance our understanding of human behavior. (shrink)

Human kinship systems play a central role in social organization, as anthropologists have long demonstrated. Much less is known about how cultural schemas of relatedness are transmitted across generations. How do children learn kinship concepts? To what extent is learning affected by known cross-cultural variation in how humans classify kin? This review draws on research in developmental psychology, linguistics, and anthropology to present our current understanding of the social and cognitive foundations of kinship categorization. Amid growing interest in kinship in (...) the cognitive sciences, the paper aims to stimulate new research on the ontogeny of kinship categorization, a rich domain for studying the nexus of language, culture, and cognition. Across the world people in different societies structure their family relationships in many different ways. These relationships become encoded in their languages as kinship terminology, a word set that maps variably onto a vast genealogical grid of kinship categories, each of which could in principle vary independently. But the observed diversity of kinship terminology is considerably smaller than the enormous theoretical design space. For the past century anthropologists have captured this variation in typological schemes with only a small number of (...) model system types. Whether those types exhibit the internal co-selection of parts implicit in their use is an outstanding question, as is the sufficiency of typologies in capturing variation as a whole. We interrogate the coherence of classic kinship typologies using modern statistical approaches and systematic data from a new database, Kinbank. We first survey the canonical types and their assumed patterns of internal and external co-selection, then present two data-driven approaches to assess internal coherence. Our first analysis reveals that across parents’ and ego’s generation, typology has limited predictive value: knowing the system in one generation does not reliably predict the other. Though we detect limited co-selection between generations, “disharmonic” systems are equally common. Second, we represent structural diversity with a novel multidimensional approach we term kinship space. This approach reveals, for ego’s generation, some broad patterning consistent with the canonical typology, but diversity is considerably higher than classical typologies suggest. Our results strongly challenge the descriptive adequacy of the set of canonical kinship types. (shrink)

Boyer & Petersen argue that folk-economic beliefs are widespread – shaped by evolved cognitive systems – and they offer exemplar beliefs to illustrate their thesis. In this commentary, we highlight evidence of substantial variation in one of these exemplars: beliefs about immigration. Contra claims by B&P, we argue that the balance of this evidence suggests the “folk” may actually holdpositivebeliefs about the economic impact of immigration.

Kinship terminologies are basic cognitive semantic systems that all human societies use for organizing kin relations. Diversity in kinship systems and their categories is substantial, but constrained. Rácz, Passmore, and Jordan explore hypotheses about such constraints from learning theories and social pressures, testing the impact of a community‐size driven learning bottleneck against the social coordination demands of different kinds of marriage and resource systems.

In their recent paper on “Challenges in mathematical cognition”, Alcock and colleagues (Alcock et al. [2016]. Challenges in mathematical cognition: A collaboratively-derived research agenda. Journal of Numerical Cognition, 2, 20-41) defined a research agenda through 26 specific research questions. An important dimension of mathematical cognition almost completely absent from their discussion is the cultural constitution of mathematical cognition. Spanning work from a broad range of disciplines – including anthropology, archaeology, cognitive science, history of science, linguistics, philosophy, and psychology – we (...) argue that for any research agenda on mathematical cognition the cultural dimension is indispensable, and we propose a set of exemplary research questions related to it. This paper does not mean to imply that it is only public controversy that can meaningfully affect political outcomes, or even that it is the most important factor. Rather, we have attempted to indicate that public controversy constitutes a forum on which political actorsact; on which they attempt to implicate each other and the public in terms of some preferred view of the controversy at hand. It is certainly the case that the formal structure of the government and power relationships (...) provides important constraints in terms of which controversy may take place. Yet within these constraints, actors can meaningfully construct various views of the structure of the controversy which differently construe the rights and obligations of participants. In this sense, the course of public controversy may in part be understood as a function of the language employed by these actors, both to the extent that particular expressions stand as documentary evidence of underlying discrepancies about the shape of the controversy and to the extent that the logic of certain speech-acts constrains the forms subsequent statements may take. Very little research has attempted to describe normal human variation in female genitalia, and no studies have compared the visual images that women might use in constructing their ideas of average and acceptable genital morphology to see if there are any systematic differences. The objective of the present work was to determine if visual depictions of the vulva differed according to their source so as to alert medical professionals and their patients to how these depictions might capture variation and thus (...) influence perceptions of ‘normality’. A comparative analysis was conducted by measuring (a) published visual materials from human anatomy textbooks in a university library, (b) feminist publications (print and online) depicting vulval morphology and (c) online pornography, focusing on the most visited and freely accessible sites in the UK. Post hoc tests showed that labial protuberance was significantly less (p<0.001, equivalent to approximately 7 mm) in images from online pornography compared to feminist publications. All five measures taken of vulval features were significantly correlated (p<0.001) in the online pornography sample, indicating a less varied range of differences in organ proportions than the other sources where not all measures were correlated. Women and health professionals should be aware that specific sources of imagery may depict different types of genital morphology and may not accurately reflect true variation in the population, and consultations for genital surgeries should include discussion about the actual and perceived range of variation in female genital morphology. "OLD TESTS ARE BEST FORGOTTEN!" Ay least that is what most students believe. "You finish your test, your teacher 'gives' you your grade and you'll never have to remember that stuff again!" It's too bad that students regard tests to narrowly. But aren't such attitudes cultivated by the popular treatment of tests as ends in themselves? For example, when is the last time you studied the traffic safety rules for your state? Probably it was thefirst time you studied them in (...) preparation for your driver's license exam. When you passed the test, did you seek out the correct answers to the ones you missed? Probably not; it would have seemed unnecessary, since you "passed." Critical reflection helps professionals to learn directly from their practice experience, so that they can improve their own work in an ongoing and flexible way - something essential in today's complex and changing organisations. It allows change to be managed in a way which enables individuals to preserve a sense of what is fundamentally important to them as professionals. It is particularly important as it can also help make sense of some fundamental issues, and so also has implications for how (...) we live our lives. However, more systematic research on critical reflection is needed to help us understand what works best for professionals in different settings. This timely work explores how critical reflection is researched, evaluated and used as a research method itself, with the aim of improving how it is taught and practised in a rigorous and transferable way. Developing a more comprehensive and multi-disciplinary view of the current state of critical reflection and the research directions which need to be taken, the book is divided into four parts. It: - Provides an overview of different perspectives on critical reflection and stimulates dialogue between them - Establishes some common platforms from which to develop further research directions - Identifies the major issues in evaluating critical reflection teaching, and main methods for doing so - Contributes to social science methodological innovations by exploring how methods based on critical reflection can be used for researching professional practice - Contains contributions from academics who are internationally known and highly experienced in different aspects of critical reflection. IntroductionHead and neck cancer diagnosis and treatment can be a significant life trauma. Some HNC survivors experience post-traumatic growth, which has been linked with better health-related quality-of-life. Empirical research on PTG, and theoretical models, point to the importance of being able to purposely make sense of the traumatic experience. Intrusive rumination, by contrast, is linked to poorer outcomes. This study explored HNC survivors’ experiences of rumination.MethodsTwenty HNC survivors between 9 months and 5 years post-diagnosis were recruited. They had a range (...) of HNC sub-types and cancer treatments. Participants underwent a semi-structured interview about their cancer diagnosis and treatment. Reflexive thematic analysis identified themes and sub-themes around rumination.ResultsFour themes with linked subthemes on the content and process of rumination were identified. Theme 1 was rumination and worry related to diagnosis. Here, survivors discussed how the HNC diagnosis and plans for treatment had dominated their initial thoughts. Theme 2 was processing the trauma of HNC. This theme reflected rumination on the traumatic experience of diagnosis and treatment and how the participant was reacting to it. Theme 3 was considering the impact. This theme encompassed retrospective thinking and comparisons between the participant now versus the early days after diagnosis. Theme 4 was continued rumination. This theme included ongoing intrusive and distressing rumination about the trauma and impact of cancer. Those who expressed ongoing rumination revisited fears or returned to negative experiences.ConclusionThis study uniquely describes the nature and content of rumination following HNC. Early intrusive rumination is common and may reflect perceptions of cancer as an existential threat. Over time, rumination can become more reflective and move towards deliberate meaning-making. Some HNC survivors may benefit from interventions to reduce barriers to this transition. The content of distressing and difficult to control rumination helps to identify those who may benefit from more directed psychological support. (shrink)

This paper examines the reasons for the high level of unmet needfor contraception in rural Egypt, using data from the individual survey andservice availability module of the 1988Ð89 Egypt Demographic and HealthSurvey. Two broad sets of potential factors are considered: characteristics ofa woman which influence her desire for children and thus her propensity touse contraception, and factors relating to the family planning serviceenvironment in which she lives. The results from a multivariate analysis showthat certain individual characteristics, such as family composition (...) andeducation, have a strong impact on the level of contraceptive use and on theproportion of total demand for spacing or limiting childbearing that is metby use of family planning. Unmet need, however, remains fairly constantacross demographic and socioeconomic subgroups of the population. Thelargest variations in unmet need are regional, but elements of the familyplanning services, namely the provision of a community-based nurse whodistributes family planning and female doctors at clinics, also play animportant role.
